  • Price extras must be disclosed on the first web page where the headline price is displayed, not kept hidden until the price review page or payment page at the end of the booking process.
  • Price extras are booking fees, credit card fees, seat selection, taxes and levies, surcharges, etc. payable on top of the headline price.
  • The rule is that prices must be transparent when an online booking is made, to comply with the Australian Consumer Law.
  • The Federal Court fined viagogo $7 million for not disclosing that a booking fee was payable until the price review page at the end. The Court added that it was not enough to state “+ booking fee and VAT” on a page without stating the amount payable.
  • A refund must be offered if the service cannot be provided, to comply with the Australian Consumer Law.
  • Jetstar had a NO REFUNDS Policy. That is, if Jetstar cancelled a flight, it offered passengers only a fare credit for another flight, not a fare refund.
  • The Federal Court fined Jetstar $1.95 million under the Australian Consumer Law: passengers are entitled to a fare refund if their flight is cancelled, even if they booked a ‘no refunds’ discount airfare.
