Liability Waivers are used to protect operators against liability for injury and death.

  • Liability Waivers are used by event and sporting venue managers, travel and tour operators, activity providers cruise providers and theme park operators.
  • Liability Waivers protect the manager, operator or provider against compensation claims, particularly claims for personal injury and financial loss, by limiting liability and transferring risk to the participant. They participate ‘at their own risk’.
  • Liability Waivers are found in either the Terms and Conditions (T&Cs) for bookings or on signage at venues. or in forms to be signed.
  • Liability Waivers must be brought to the participant's attention before entry or commencement or completion of the booking.
  • For example, when making an online booking, a liability waiver applies when the person making the booking clicks the box captioned:
    "I have read and accept the Terms and Conditions"
    before being able to proceed to the payment screen.
  • Liability Waivers can extend to everyone who is covered in the booking / is issued an entry ticket.
